PC Gary Tester cleared of Premier Inn night porter assault
A police officer accused of attacking a Premier Inn night porter has had the case against him dismissed.
PC Gary Tester, 43, of Avon and Somerset Police, had pleaded not guilty at Swindon Magistrates' Court to a single charge of assault by beating.
Judge Simon Cooper criticised Wiltshire Police for taking six months to make CCTV available to the defence team.
"I can't see an assault... the case is dismissed," he said.
"From viewing CCTV it is not clear to me that there was any physical contact or that the night porter was in fear of his own safety," the judge said.
"We are so short of evidence that the case is dismissed."
A statement from Wiltshire Police said the force was "satisfied that all relevant information was provided within the necessary timeframes given".
Mr Tester is still waiting to hear the results of an internal investigation by Avon and Somerset's Professional Standards Unit.
