Aberdeen death crash driver attacker has sentence cut

A man who took part in an attack on a drink-driver who crashed a car and left an eight-year-old boy dead has had his sentence cut.

Corby Clark, 26, attacked David Jones after he was released from jail.

Jones lost control of a car on a bend in Aberdeen in October 2003. Passenger Stephan Henderson died.

Clark was jailed for two years and three months in December. Judges at the Court of Criminal Appeal in Edinburgh reduced the prison term to 18 months.

Co-accused Andrew Henderson had been jailed for three years after admitting attacking Jones to his severe injury and permanent disfigurement by striking him on the head with a knife.

Lord Drummond Young, who heard the appeal with Lady Smith, said Henderson was "the main attacker" who had used a knife.

At Aberdeen Sheriff Court, the pair had earlier admitted the attack.

Fiscal depute Anne MacDonald said of the original crash victim: "The child was the son of Mr Henderson's partner at that time."

Sheriff Edward Savage described the case as an "extremely serious offence" and said he was satisfied that a custodial sentence was inevitable.
