Stranraer fatal crash motorist receives driving ban

A pensioner found guilty of causing the death of a woman by careless driving has been given a 12-month driving ban and 150 hours community service.

John Agnew, 78, of Stranraer, had denied committing the offence in December 2009.

Emma McIntyre, 75, died in the incident near to the town's High Kirk graveyard.

Sheriff Kenneth Robb described it as a "very unfortunate accident" which had a big effect on Ms McIntyre's family and the accused.

A jury trial at Kirkcudbright Sheriff Court heard that Ms McIntyre died after she was struck by Agnew's car but conditions had been poor and it had been a dark, wet night.

Sheriff Robb said that although Agnew had been driving slowly, it had not been slow enough to allow him to stop.
