Child porn case images 'not missing'

Police have denied that files had gone missing ahead of the trial of a man accused of possessing indecent images of children.

Darryl Weir, from Dundee, denies downloading and distributing pictures of children at an address in Cupar.

Cupar Sheriff Court heard claims on Thursday that police could not find the images and the case was continued to a date later this month.

However, police later said no evidence had been lost.

Lawyer Douglas Williams, defending, said: "There are complications with regard to the images.

"The last I heard from the police they said they had lost them and they queried whether we needed to see them.

"Clearly that was not acceptable."

Sheriff Charles Macnair said: "It can't go to trial if the images are lost."

However, Fife Constabulary said: "We can confirm that no evidence has been lost in this case and that court proceedings are timetabled for future appearances."

Mr Weir, 20, denies two charges of downloading indecent images of children and distributing them in April 2009.
