A Montana judge has scheduled an execution date for the only known Canadian on death row in the US.

District Judge John Larson set an execution date of 31 January for Ronald Allen Smith, who is seeking a court ruling on whether the state's execution method is unconstitutional.

On Monday, another judge in Helena had issued an injunction temporarily halting the January death sentence.

The 53-year-old was convicted of killing two Montana men in 1982.

Mr Larson will now ask Montana's Supreme Court to resolve the two conflicting rulings before January, according to local media reports.

The Canadian government has asked state officials to grant Smith, from Alberta province, clemency.
