Charges against one of the Derby men accused of attacking a policeman during a stag weekend in Latvia have been dropped.

Police said charges had been dropped against David Birkinshaw. However, his co-defendant, Matthew Neale, will need to return to court in Riga in October.

The incident is alleged to have happened outside a bar in June 2008.

The two men were acquitted of the offence in October but faced a retrial after an appeal by the prosecution.

That hearing was postponed earlier this year because the alleged victim was unwell.

David Birkinshaw and Matthew Neale, who have both always denied their involvement, appeared in court in Riga for the retrial on Thursday.

They were extradited to Latvia in the summer of 2009 and detained at Riga's Central Prison where they spent about two months awaiting their first trial.
