Northampton Boxing Day rapist's reviewed sentence now life
A "brutal" rapist has had a seven-year prison sentence overturned and replaced with a life term after a review.
Gintas Burinskas, 37, pleaded guilty to rape and GBH with intent, at Northampton Crown Court last April.
Burinskas, who had already served 10 years for rape, attacked a 31-year-old woman early on 26 December 2012 as she walked alone in Northampton.
Lord Thomas, Mr Justice Mitting and Mrs Justice Thirlwall at the Appeal Court agreed his sentence was unduly lenient.
Burinskas arrived in the UK in November 2012 following his release from prison in Lithuania.
After admitting one count of rape and one of causing GBH with intent against his victim he was sentenced to seven years jail and an extended licence period of three years.
Attorney General Dominic Grieve asked for a review of the sentence, saying it was unduly lenient.
Lord Thomas announced the original sentence had been quashed and replaced with a life sentence with a minimum term of six years.
"This was a very serious, sustained, brutal attack by a very dangerous man on a vulnerable woman at night," he said.
Lord Thomas described how Burinskas had walked up behind his victim and grabbed her round the throat.
"She fought him, and shouted, but he increased the pressure on her throat and she lost consciousness."
She awoke and pleaded with him to stop then tried to push him off. He hit her repeatedly to the face and grabbed her by the throat yet again, Lord Thomas said.
The victim suffered fractures to her jaw and lost two teeth. Surgery was needed for the damage to her jaw and face.
The woman was "devastated" by the incident and thought "she was going to die".
Solicitor General Oliver Heald said after the hearing: "This was a particularly vicious, prolonged and totally unprovoked attack where the victim feared for her life.
"I felt the original sentence was too low, given that Burinskas had only recently been released from a 10-year sentence of imprisonment for a rape committed in his native Lithuania."
