Borders A1 death crash driver freed pending appeal

An HGV driver whose lorry crushed a Fife surgeon to death after skidding on ice and snow on the A1 in the Borders has been freed pending an appeal.

Marc Bell, 38, of Gateshead, has served 53 days since being jailed.

Until a recent change in the law, careless driving could not lead to prison, even when it led to a fatal accident.

Bell will return to the Court of Criminal Appeal next month to hear whether his 12-month term should stand.

He was found guilty by a jury last year of careless driving before the crash in which Dr Mahmoud Abdel-Fattah, 42, from Dunfermline, lost his life.

He was also banned from driving for two years - and that ban remains in force.
